These Terms of Use ("Terms") govern your access to and use of moondogplace.com and any related pages, content, or features made available by Moon Dog Ventures LLC ("Moondog," "we," "us," or "our") (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
The Service is a marketing and informational website that describes Moondog's short-term rental property management offerings and allows visitors to submit inquiries, request property revenue forecasts, browse representative properties, and connect with our team. Actual property management services, bookings, and any owner-side platform access are governed by separate agreements between Moondog and the relevant party.
You must be at least 18 years old and legally capable of entering into binding contracts to use the Service. By using the Service, you represent and warrant that you meet these requirements.
When you submit information through any form on the Service — including the forecast request form, the partner contact form, or the interactive coverage map — you agree that:
Forecast figures, sample numbers, and projections shared via the Service are illustrative only and do not constitute a guarantee of revenue, occupancy, or any other outcome.
Nothing on the Service constitutes an offer, contract, or agreement to provide property management services. Any actual engagement between Moondog and a property owner is governed by a separately executed management agreement, which controls the relationship in the event of any conflict with these Terms.
You agree not to:
All content on the Service — including the Moondog name, logo, brand assets, text, images, layouts, and software — is owned by Moondog or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or otherwise exploit any of the Service's content without our prior written permission, except for limited personal or internal business use that does not compete with Moondog.
Property photographs on the Service may be subject to additional rights held by photographers, property owners, or our property management platform. They are displayed solely for illustrative purposes.
The Service incorporates and links to third-party services, including Guesty (our booking platform), Google services (analytics, storage, mapping), and external URLs we link to from time to time. Moondog is not responsible for the content, practices, or policies of any third-party service. Your use of any third-party service is at your own risk and subject to that third party's own terms and policies.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. To the maximum extent permitted by law, Moondog disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Service will be uninterrupted, secure, error-free, or free of harmful components. Information presented — including property listings, forecasts, market data, and operational statistics — is provided for general informational purposes only and should not be relied upon as legal, financial, tax, or investment advice.
To the maximum extent permitted by law, in no event will Moondog, its affiliates, officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including but not limited to lost profits, lost revenue, lost data, loss of goodwill, or business interruption — arising out of or related to your use of the Service, even if Moondog has been advised of the possibility of such damages.
To the maximum extent permitted by law, Moondog's total aggregate liability for any claim arising out of or related to the Service is limited to one hundred U.S. dollars ($100). Some jurisdictions do not allow the exclusion or limitation of certain damages, so portions of this section may not apply to you.
You agree to defend, indemnify, and hold harmless Moondog and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or related to your violation of these Terms or your misuse of the Service.
We may modify, suspend, or discontinue any part of the Service at any time without notice. We may also update these Terms from time to time; when we do, we will revise the "Last updated" date above. Material changes will be communicated through reasonable means. Your continued use of the Service after any update constitutes your acceptance of the revised Terms.
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason — including any violation of these Terms. Provisions intended to survive termination (including Sections on Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law) will continue to apply.
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Florida, and you consent to the personal jurisdiction of those courts. You waive any objection to venue in those courts.
Entire agreement. These Terms, together with our Privacy Policy and any separate agreement governing actual property management services, constitute the entire agreement between you and Moondog regarding the Service.
Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
No waiver. Our failure to enforce any right or provision will not constitute a waiver of that right or provision.
Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms freely.
